Zahir Homes (“Zahir Homes,” “we,” “us,” or “our”) is operated by Zahir U. Ahmed, GRI, a licensed New York Real Estate Salesperson (License #10401301102) affiliated with Voro LLC (“Voro” or the “Brokerage”). The Broker of Record is Danny Shamooil. This Privacy Policy explains how we collect, use, share, and protect your personal information when you visit https://homesbyzahir.com/ (the “Site”) or contact us.

By using the Site, you agree to this Privacy Policy. If you do not agree, please do not use the Site.

2. Information We Collect

Information you provide to us

• Name, email address, phone number, and mailing address
• Property preferences, budget, and timeline
• Information you submit through our contact form and property inquiry form
• The content of messages you send by email, phone, or WhatsApp
• Information you provide if you register for a property search account, save searches, or save favorite listings through our listing search tool

Information collected automatically

• IP address, browser type, device type, and operating system
• Pages viewed, time spent, and referring website
• Essential cookies and similar technologies (see Section 5)

Information from third parties

• Listing and property data from OneKey® MLS
• Information from other real estate platforms (such as Zillow) if you contacted us through them

We do not knowingly collect sensitive information such as Social Security numbers, bank account details, or government ID numbers through the Site. Please do not send such information through our forms or by email.

3. How We Use Your Information

We use your information to:

• Respond to your inquiries and provide real estate services
• Send property information, listing alerts, and updates you request
• Arrange showings and communicate about transactions
• Contact you by email or phone about our services, as permitted by law
• Operate, secure, and improve the Site
• Meet legal obligations, including recordkeeping required of New York real estate licensees and brokerages
• Protect against fraud and misuse

4. How We Share Your Information

We do not sell your personal information. We may share it with:

• Voro LLC, our brokerage, for supervision, compliance, recordkeeping, and transaction support
• IDX Broker and other service providers that host and operate our listing search tools, website, email, and communications. They may process your information only to provide services to us.
• Transaction participants such as lenders, attorneys, title companies, inspectors, appraisers, and other agents, when needed for a transaction you ask us to pursue
• OneKey® MLS and its participants, to the extent required by MLS rules
• Legal and regulatory authorities, when required by law, subpoena, or to protect rights and safety, including the New York Department of State
• A successor, in connection with a business sale, merger, or reorganization

5. Cookies and Similar Technologies

We do not use third-party analytics or advertising trackers on the Site. The Site, our hosting provider, and our listing search tool (IDX Broker) may use cookies that are necessary to run the Site, remember your session, and support features such as saved searches and favorites. You can control cookies through your browser settings, though blocking them may affect some Site features.

Do Not Track: The Site does not currently respond to “Do Not Track” browser signals. Because we do not use advertising trackers, we do not engage in cross-context behavioral advertising.

6. Email and Telephone Communications

• Email: Marketing emails include an unsubscribe link, in line with the CAN-SPAM Act. We honor unsubscribe requests within 10 business days.
• Telephone: We may contact you by phone about real estate services. We comply with the Telephone Consumer Protection Act (TCPA), the FTC Telemarketing Sales Rule, and the New York Do Not Call laws. We check the National Do Not Call Registry where required and keep an internal do-not-call list. If you ask us to stop calling, we will add your number to that list and honor the request. We may still contact you where permitted by law, such as when you have made an inquiry or have an existing business relationship with us.
• Messaging apps: If you contact us through WhatsApp or similar apps, we will use them to reply to you. We do not send bulk or automated marketing text messages.

Depending on where you live, you may have the right to:

Residents of other states: If your state has a comprehensive privacy law (such as Virginia, Colorado, Connecticut, or Texas), you may have similar rights. If we deny your request, you may appeal by replying to our response.

8. Data Security

We use reasonable administrative, technical, and physical safeguards to protect your information, consistent with the New York SHIELD Act. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a breach affecting your information occurs, we will notify you as required by law.

9. Data Retention

We keep personal information only as long as needed for the purposes in this policy, including legal and recordkeeping requirements. New York licensees and brokerages must keep certain transaction records for at least three years, and Voro may keep records longer under its own policies.

10. Children’s Privacy

The Site is not directed to children under 13, and we do not knowingly collect their information. If you believe a child has given us personal information, contact us and we will delete it.

11. Third-Party Links and Services

The Site may link to third-party sites (such as Zillow, Facebook, LinkedIn, and Voro). We are not responsible for their privacy practices, so please review their policies.

12. Changes to This Policy

We may update this Privacy Policy from time to time. The “Last Updated” date shows the latest revision. Continued use of the Site means you accept the changes.
